Why This Page Exists

R44 Performance sells parts that make cars faster, louder, sharper and better to drive. A good number of those parts change something a vehicle was originally certified with — the exhaust after the turbo, the catalytic converter, the particulate filter, the engine map, the intake, the suspension geometry, the lighting. That is the entire point of them. It is also the reason this page exists.

Whether a given part can lawfully be used on a public road depends almost entirely on where that road is. A downpipe that is a completely ordinary track-day part in one country is a criminal offence to fit to a road car in another. The same box, the same part number, two totally different legal answers. We ship worldwide, so we cannot write one rule that covers everybody — but we can be straight with you about it rather than burying a line of small print at the bottom of a checkout page.

So here is our position, in plain English:

  • Assume a performance part is off-road, track or competition use unless we have specifically told you otherwise. If a listing says "road legal", "E-marked", "ECE approved", "type approved" or quotes a CARB EO number, we mean it. If it says nothing, do not assume.
  • Ask us before you order, not after. Our team knows this catalogue extremely well and will happily tell you what a part does to a vehicle's emissions, noise and approval status. We would far rather spend ten minutes on an email than have you fail an inspection.
  • We will tell you when the honest answer is "don't". If a part is a bad idea for how you have described using the car, we will say so, and we will point you at something that is not.
  • We reserve the right to refuse or cancel an order where we believe a part is intended for unlawful use on a public road.

What we cannot do is tell you what is legal on your specific vehicle, in your specific town, under your specific inspection regime, or guarantee how an individual inspector or insurer will treat a modification. Those rules differ by country, by state or province, sometimes by city, and they change. That responsibility sits with you as the owner of the vehicle — and the summaries below are there to give you a running start on it.

United Kingdom

In short: track and off-road use is not the problem. Fitting emissions or noise-affecting parts to a road-registered, MOT'd car is where UK owners get caught out.

  • The MOT test includes emissions checks and a visual inspection for emissions equipment. A car presented with a missing or defeated catalytic converter, DPF or GPF will fail, and the tester is required to record it.
  • Removing or defeating emissions control equipment on a road-going vehicle is an offence under the Road Vehicles (Construction and Use) Regulations 1986, quite separately from the MOT.
  • Replacement exhausts must not make the vehicle noisier than it was when it was type approved, and silencers on most modern cars are expected to carry the appropriate marking. Roadside enforcement and local-authority noise cameras do act on this.
  • Almost every modification — exhaust, remap, intake, suspension, wheels, aero — must be declared to your insurer. An undeclared modification can invalidate cover entirely, which is usually a far more expensive problem than the MOT.
  • Vehicles used only on private land, on track or in competition are outside the road traffic regime and can be built as you like.

What this means when you order from us: de-cat and decat downpipes, sports cats without approval, GPF/DPF delete pipes and the maps that go with them are supplied for off-road, track and competition use only. Non-emissions parts — most suspension, brakes, styling, cooling and interior products — are generally unaffected, but check anything that alters lighting or ride height.

Ireland & the EU / EEA

In short: broadly similar to the UK in principle, but several member states are considerably stricter in practice, and Germany is the strictest of all.

  • Periodic roadworthiness testing applies across the EU/EEA under national schemes — the NCT in Ireland, the Hauptuntersuchung (TÜV, DEKRA and others) in Germany, the contrôle technique in France, the APK in the Netherlands, and equivalents elsewhere. Emissions equipment is checked.
  • Tampering with emissions control equipment on a road vehicle is prohibited EU-wide, and several states treat it as a serious offence rather than a technicality.
  • Germany in particular: parts generally need their own approval — an ABE, an EC/ECE type approval, or a Teilegutachten followed by an inspection and entry into the vehicle's papers. Fitting an unapproved part can invalidate the vehicle's operating permit (Betriebserlaubnis) and, with it, your insurance. Do not assume a UK-market part is acceptable.
  • Since Brexit, orders shipped from the UK into the EU are imports. Duties, import VAT and customs clearance apply, and some carriers will hold emissions-related parts.
  • Track and motorsport use is, as in the UK, a separate matter and generally unrestricted.

What this means when you order from us: if you are in Germany, Austria or Switzerland, please talk to us before ordering exhaust, suspension or lighting parts so we can tell you what approval documentation, if any, exists for that product. For most other member states the UK guidance above is a reasonable guide, but your national test is the authority.

United States

In short: the strictest enforcement environment we ship into, and the one where you most need to know your own state's rules before you click buy.

  • Federal law — the Clean Air Act — prohibits removing or rendering inoperative any emissions control device on a road vehicle, and prohibits selling parts whose principal effect is to defeat one. The EPA has actively enforced this against tuners, installers and retailers in recent years.
  • California, and the states that have adopted California standards, additionally require aftermarket parts affecting emissions to hold a CARB Executive Order (EO) number to be legal for street use. No EO means off-road only, whatever the part does.
  • Inspection regimes vary enormously by state — some run OBD-II and visual checks annually, some by county, some not at all. A part that passes unnoticed in one state will fail in the next one over.
  • Race, competition and dedicated off-road vehicles are treated differently from street-registered vehicles, and that distinction is the one that matters.

What this means when you order from us: we do not represent any product as EPA-compliant or CARB-compliant unless the listing explicitly says so and quotes the EO number. Everything else is supplied for off-road, race and competition use only, and by ordering you are confirming that is how it will be used. Please check the EPA's guidance on aftermarket parts and tampering, and CARB's aftermarket parts database, before you order.

Canada

In short: federal emissions rules plus a patchwork of provincial equipment, noise and inspection rules.

  • Federal on-road vehicle emissions regulations under the Canadian Environmental Protection Act govern emissions control equipment on road vehicles.
  • Provinces set their own rules on inspections, equipment standards, exhaust noise and out-of-province vehicle admission — Ontario, British Columbia and Quebec each work differently.
  • Municipal noise by-laws are actively enforced in several major cities and are a common cause of tickets for loud exhausts.
  • Import duties, taxes and brokerage apply to orders shipped from the UK.

What this means when you order from us: treat emissions and exhaust parts as off-road and track use unless your province tells you otherwise. Check your provincial transport authority's equipment standards before fitting anything to a road car.

Australia & New Zealand

In short: modification rules are formalised and genuinely enforced, and both countries have a certification route for road-legal modifications.

  • Australia: vehicles must continue to meet the Australian Design Rules. National guidance on modifications sits in the Vehicle Standards Bulletin (VSB14), with each state and territory operating its own approval, engineering certification and defect-notice system. Emissions-related modifications are among the most tightly controlled categories.
  • State enforcement — defect notices, "canary" and "yellow sticker" stickers, and EPA-issued noise and emissions notices — is common in NSW, Victoria and Queensland in particular.
  • New Zealand: the Warrant of Fitness applies, and many modifications require Low Volume Vehicle (LVV) certification to remain road legal.
  • Motorsport, club-level competition and off-road vehicles operate under separate rules.

What this means when you order from us: if you intend a part for road use, please check with a certifier or your state authority first — the certification route exists and works, but it needs to be planned before you buy, not afterwards. Otherwise, parts are supplied for track and competition use.

Rest of the world

In short: we ship almost everywhere, and almost everywhere has its own inspection and approval regime.

  • Japan operates the shaken inspection, with noise and emissions standards that replacement exhausts must be certified against.
  • The Gulf states, Singapore, South Africa and most of Asia run periodic inspection or registration checks covering exhaust, emissions, lighting and glazing.
  • Many countries restrict the import of emissions-defeating parts at the border, and customs may hold or seize them regardless of what we have written on the paperwork. We will not mis-declare goods to get around this.
  • Import duties, taxes and clearance charges are the customer's responsibility in all territories.

1. Off-Road, Track & Competition Use Only

Products that fall under this disclaimer include, but are not limited to:

2. UK & EU Road Legality

R44 Performance is based in the United Kingdom. Many aftermarket performance parts we supply may not comply with the Road Vehicles (Construction and Use) Regulations 1986, UK or EC/UNECE type approval requirements, MOT testing requirements, or national and local noise and emissions standards in the UK, the European Union or any other territory.

Under UK law it is, in general, an offence to use a vehicle on a public road if a component required for emissions control has been removed, disabled or rendered less effective, or if the vehicle no longer meets the noise or construction standards it was type approved to. Vehicles presented for an MOT with a missing or tampered catalytic converter, DPF or GPF will fail the test.

It is your sole responsibility to:

  • Understand the road traffic, type approval, noise and emissions laws that apply where the vehicle is registered and used, before placing an order
  • Determine whether a product may lawfully be fitted to your vehicle for the use you intend
  • Check whether a part carries the E-mark, type approval or homologation required in your territory, where such approval is required
  • Declare all modifications to your motor insurer, and satisfy yourself that your cover remains valid
  • Understand that fitting a non-compliant part to a road-going vehicle may result in an MOT failure, a roadworthiness prohibition, fines, penalty points, prosecution or vehicle seizure

3. United States — EPA, Clean Air Act & CARB

Many aftermarket performance parts sold on this website do not comply with United States Environmental Protection Agency (EPA) regulations, the Clean Air Act, or state-level emissions standards, including but not limited to California Air Resources Board (CARB) requirements.

If you are ordering from, or shipping to, the United States, it is your sole responsibility to:

  • Research and understand all applicable federal, state and local emissions laws in your jurisdiction before placing an order
  • Determine whether a product is legal for your intended use in your state before purchasing
  • Verify whether a product is CARB-exempt or CARB-compliant where your state requires it — California residents especially
  • Understand that installing non-compliant parts on a street-driven vehicle may result in failed emissions inspections, fines, citations, vehicle impoundment or other legal consequences

R44 Performance does not guarantee that any product complies with emissions law in your state or jurisdiction unless the product listing expressly states otherwise (for example "CARB EO number issued" or "50-state legal"). Parts sold by R44 Performance are not offered or represented as EPA-compliant emissions-related replacement parts for road use in the United States.

4. Shipping & Export Restrictions

R44 Performance does not knowingly ship emissions-defeating or off-road-only parts to countries, states or jurisdictions in which such products are unlawful, unless the customer confirms that the product is being purchased exclusively for race car, track or off-road vehicle use.

By completing a purchase, you represent and warrant that any off-road or non-compliant product will be used solely for lawful off-road, track or competition purposes. We reserve the right to refuse, cancel or refund any order at our discretion where we believe a product is intended for unlawful use, and to require written confirmation of intended use before an order is dispatched. We will not mis-describe or under-declare goods on customs paperwork under any circumstances.

5. Vehicle Warranty Disclaimer

Fitting aftermarket performance parts may affect or void all or part of your vehicle's manufacturer warranty, extended warranty or approved-used warranty.

In the UK and EU, block exemption rules mean a manufacturer cannot automatically void an entire warranty simply because an aftermarket part has been fitted; however, a manufacturer or dealer may refuse a claim where it believes the part contributed to the failure. In the United States, the Magnuson-Moss Warranty Act provides comparable protections, but individual dealers and manufacturers interpret warranty coverage differently.

R44 Performance is not responsible or liable for any warranty claim refused or reduced by a vehicle manufacturer, dealer or warranty provider as a result of parts purchased from us being fitted. This includes, without limitation, engine, powertrain, drivetrain, emissions system and any related warranty coverage. Our own product warranty position is set out in our Warranty Policy.

6. Professional Installation

All performance and aftermarket parts should be fitted by a qualified professional technician or a competent specialist workshop, using the correct tools, torque figures and procedures. Improper installation can cause vehicle damage, component failure, fire risk, safety hazards or a voided warranty.

Fitting guides, torque figures and instructional content published by R44 Performance are provided for general guidance only and do not replace manufacturer instructions or professional judgement. R44 Performance is not liable for any damage, injury, loss or issue resulting from incorrect, incomplete or unsuitable installation, or from installation carried out by the customer or by a third party.

7. Assumption of Risk & Waiver of Liability

By purchasing performance or aftermarket parts from R44 Performance, you acknowledge, agree and represent that:

  • The product may be intended for off-road, track, race or competition use only
  • You will use off-road products only for lawful off-road, track or competition purposes, and will not use them on public roads in breach of applicable law
  • You are solely responsible for determining the legality of purchasing, fitting and using the product in your jurisdiction
  • You assume all risk associated with the purchase, installation and use of aftermarket parts, including use on track, at competitive events and in motorsport
  • To the fullest extent permitted by law, R44 Performance shall not be liable for any fine, penalty, citation, failed test or inspection, roadworthiness prohibition, vehicle seizure, prosecution, legal cost, vehicle damage, engine or component failure, personal injury, or any other loss or damage arising from the purchase, installation or use of products bought from this website

8. No Returns or Cancellations for Compliance Reasons

R44 Performance does not accept returns, exchanges or cancellations on the basis that a customer has discovered after ordering that a product is not road legal in their country or state, will not pass an MOT or emissions inspection, is not type approved, is not CARB-compliant, or otherwise does not meet a local regulatory requirement — unless the product listing expressly stated that it was compliant and it is not.

While we work hard to provide accurate product descriptions, fitment data and specifications, R44 Performance does not guarantee that every listing carries complete emissions or compliance information. Manufacturers also change specifications, approvals and part content without notice.
